What is the motor dealers and repairers compensation fund?
When you sell or purchase a vehicle via a licensed motor dealer or when a licensed motor vehicle repairer performs repair work, you are protected by the motor dealer and repairers compensation fund. This is why it is always a good idea to purchase your camper trailer, caravan or mobile home through a fully licensed dealer.
When protected by the fund, you are able to file a claim if losses are incurred when selling or buying a motor vehicle via a licensed dealer. You are also covered if you incur losses resulting from repair work on your vehicle via a licensed repair. The motor dealers and repairers compensation fund allows you to make a claim against a repairer or dealer who has ceased operations. It is recommended that you contact the dealer or repair directly for a resolution before lodging a claim.
Looking at what you can make a claim for, the following are covered.
- Incompetent repair work
- The dealer failed to return or repay a deposit
- Dealer sold you a stolen vehicle
- The dealer fails to meet warranty obligations
- Dealer fails to pause on proceeds from the sale of a vehicle on behalf of a customer
How to make a claim?
To make a claim with the motor dealers and repairers compensation fund, you need to fill in and fully complete a claim form. You will also need to provide supporting or documentary evidence, which may include the following:
- Any invoices or receipts from the transaction
- Prescribed notice
- Consignment agreement or sales contract
- Proof of payment via check or bank statement
- Financial contract
- Motor vehicle ownership proof
- Any repair work quotes
If you have already taken the matter to court or the tribunal, full details of the outcome from the hearing should also be provided. Ensure that you specify the repair or dealer relating to the claim. You should also make all circumstances leading to your losses and how much you have lost clear too.
The time frame for making a claim and how much will I get?
When making a claim, you have 12 months from the date that you become aware of the loss or damage to from when the loss is incurred. The fund stipulates that the maximum payment you are able to receive is capped at $40,000. This will undoubtedly provide some relief for those caught up in ongoing disputes.
Situations where you can’t make a claim
There are certain situations where you are unable to file a claim for a loss. These include when an injury or death has resulted for the need to make a claim. When you tried to claim for any other property than the vehicle itself and when the issue arises after improvements are made following the date of purchase.
There are also certain vehicles that you aren’t able to make a claim for. These include the following:
- A conveyor, hoist or crane
- A motor vehicle that cannot be registered in NSW
- A forklift, bulldozer, road roller, road grader or excavator
- A motorcycle that is older than 10 years
- Motor vehicle that is over 35 years old
- Any motor vehicle not primarily used for private purpose
- Motor vehicle that has had modifications for use in off-road motorsports or motor racing
- Any vehicle adapted for or constructed for road maintenance or construction
It’s also important to note that if you are a repair, motor vehicle recycler, finance, wholesaler or a dealer in the trade, then you are prevented from launching a claim. Those who have had previous repair and vehicle warranty disputes are also prevented from making a claim from the fund.
